Section 21 National Assistance Act 1948 – residential accommodation – provision of other services
The council was mistaken it its belief that the only accommodation it could offer under s21 NAA 1948 was accommodation which included a package of services such as food, laundry, and facilities to maintain personal hygiene. The wording of s21(5) and s26(1A) of the Act clearly indicated that residential accommodation without board and personal care could be provided. Other services could be provided ‘in connection’ with the accommodation, not necessarily in it, as part of a package.
