Mentally handicapped persons being looked after in a nursing home are not entitled to receive the higher rate of income support because they are undergoing ‘medical or other treatment’ as an in-patient in a ‘hospital or similar institution’ free of charge for the purposes of >Income Support (General) Regulations 1987<, regulations 17 and 2(1) and (3) and Social Security (Hospital In-Patient) Regulations regulation 2(2).
