Consultation – registration of nursing homes
Although there was no statutory duty to do so, the health authority was nonetheless under an obligation to conduct adequate consultation with the owners of the nursing homes on its register, before deciding that multi-bedrooms should be phased out. In this particular case, the court held that the issue at hand was sufficiently important to merit individual consultation with the home owners. The procedure adopted by the health authority was found to be unfair and unreasonable, and the decision was therefore quashed.
