An illegal immigrant could be deported from the UK under the Immigration Act 1971, notwithstanding the immigrant’s detention in hospital under s48 Mental Health Act 1983 and was not a breach of Article 3 of the European Convention on Human Rights. It was sufficient that the Secretary of State had taken the claimant’s mental illness into account
