Section 21 NAA 1948 – illegal immigrants- eligibility

Public policy precluded illegal entrants and overstayers (as opposed to asylum seekers awaiting determination of their case) from eligibility for assistance under s21 National Assistance Act 1948 unless they were unfit to travel. A person could not acquire a right to assistance by virtue of a criminal offence or wrongdoing.
