Domiciliary care package – cost-capping
The council’s reassessment and proposed cut to the applicant’s domiciliary package, capping the package at £240 a week for 39 hours, was challenged on the grounds that the £240 ceiling amounted to resource-led provision, rather than being based on the applicant’s needs. Shortly before the hearing, the council increased the package to 45 hours per week at a cost of £280, thereby avoiding a finding that it had acted perversely or irrationally.
