Monitoring officer – complaint

This was an application for judicial review of the failure of the council’s Monitoring Officer to examine the applicant’s complaint, thereby failing to discharge his statutory duties. The case was settled by consent, with the council accepting that the MO, in referring the applicant’s complaint back to social services and to the legal department, had failed to consider whether the matters complained of had given rise to, or were likely to give rise to, illegality or maladministration, as he was bound to do under the Local Government and Housing Act 1989.
