The CHC National Framework doesn’t say exactly that, no. It says that the identifying the scope of social care, for the question of eligibility decision making as to who has a primary health need – regarding the sort of profile of need that is beyond that which a council can lawfully be expected to provide – is related to the eligibility criteria for the Care Act. It does not say that whatever domains a person was regarded as eligible ‘in’ under the Care Act ‘must’ be met by the ICB once the person’s need exceeds the scope of the Care Act, even if the scope of social care is exceeded in terms of the quantity of the response needed or through the nature of the response needed
