The lawful power of the NHS to meet need extends to care and aftercare and care is broad enough to include support, so there are no areas of need that might be regarded as areas of need for social care that could NOT be met by the ICB. But that does not mean that they must be met.
If you can get an ICB to assert that it does not have the power to provide something, the chances are that that is an error of law. If all you can do is get them to say that their financial resources are the reason why they will NOT provide something, that is likely to be harder to involve a lawyer in challenging.
