If – say – three good friends, persons A, B and C, with special needs want to live together in supported living with a support package in place, one of those friends, C, is from out of area ie another council, can the out of area council refuse to pay the care needs of C after he/she moves into the house in new council area?

The answers to the first and second questions all depend, on the rules of continuity versus continuing ordinary residence. A move into supported living out of area is able to carry with it the responsibility of the previous council, but ONLY if they put the magic words on the care plan. My Council has said no to funding our son’s care in a property we own. They have said ‘they are not setting up any further supported housings through families’ properties’ indicating that our son must go into supported living in another area away from everything he knows locally and is familiar with. Can the council do this? Can my son not choose where he live? The Council said they will only ‘support C in the home with drop in support’ ! Is there a process to appeal this?

My son with Down Syndrome wants to move into supported accommodation locally with his 2 friends.
